A shooting outside an Atlanta Chevron station reportedly claimed the life of Kenneth Oglesby Thursday afternoon, October 6, 2016.

According to WSB-TV 2, Mr. Oglesby “was at his car at the Chevron at 3535 Roosevelt Highway when the gunman approached.” The assailant apparently opened fire and “tried to leave in [Mr. Oglesby’s] car, but could not get it to start.” Family members told WSBTV Mr. Oglesby will be remembered as a “good father” with a “great sense of humor.”

Our Legal Take

Gas station patrons have a right to feel safe and secure while on premises of the establishment they are visiting. The Murray Law Firm regularly represents victims of gas station violence in Georgia, and questions the level of security provided and whether this tragic loss of life may have been prevented.

What security measures, such as surveillance cameras and security patrols, were in place to protect patrons at the time of the shooting?

  • Was the gas station owner aware of any prior incidents of violence on or near the property?  If so, were additional security precautions implemented by the property owner or management to deter crime?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the gas station owner or management failed to provide adequate security, the family of Kenneth Oglesby may elect to seek justice and pursue a legal claim for his wrongful death.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.
