Could This Violent Apartment Home Invasion Have Been Prevented?

Local News

A reported robbery home invasion at the Laurel Mill Apartments reportedly left Torey McCommons and Jessie Baptiste injured Monday morning, March 20, 2017.

According to CBS 46, gunfire erupted after “a man knocked on the door” and “forced his way inside” an apartment.  11 Alive reports, Ms. Baptiste was struck “in the leg as she tried to crawl out a window with her baby in her arms.” Mr. McCommons suffered a gunshot wound to the chest. The intruder apparently escaped with “a jar of coins.”

11 Alive reports, “there were a number of crimes in the area in recent months, including four assaults, six car break-ins, 9 thefts and three robberies.”

Our Legal Take

Apartment complex residents and guests have a right to feel safe and secure while on the premises. If this shooting happened on the property of the apartment complex, The Murray Law Firm questions the level of security provided to those at the property and whether this shooting may have been prevented.

  • How did the intruder gain entry to the property? What security measures, such as gated entry, surveillance cameras, bright lighting, and security patrols, were in place and working at the time of the shooting?
  • Were any additional security precautions implemented by the apartment complex owner or management company to deter crime and protect residents, following recent media reports of local criminal activity?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that this shooting happened on the property of the apartment complex, and that apartment complex owner or management failed to provide adequate security, Mr. McCommons and Ms. Baptiste may elect to pursue legal claims for their injuries.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.

Did negligent security contribute to two deadly Atlanta shootings in one month?

Local News

A teenage boy was reportedly shot and killed on the playground outside of the Edgewood Court apartment complex Thursday, March 9, 2017.

According to WXIA reports, the fatal shooting occurred “in the 1500 block of Hardee Street at Edgewood Court Apartments – a complex in the Edgewood neighborhood of Atlanta.”

The tragedy comes only one month after a deadly shooting claimed the life of another young man outside the same complex, FOX 5 reports.

Following that incident, Atlanta Police apparently told FOX 5, “Although this is a public safety issue, there are some steps needed from Edgewood Court Apartments since it is private property. We just aren’t able to occupy their property 24 hours a day.”
