Security Lapse? Our Legal Take: 1 Injured in Decatur Apartment Shooting

Did negligent security contribute to this shooting? Read Our Legal Take to find out if the if the victim may have a legal avenue for justice and a claim for compensation.

Local News

A shooting outside the Creekside Forest Apartments reportedly left one man with critical injuries Thursday night, August 11, 2016.

WSBTV 2 reports, “the victim was shot in the chest Thursday nightin the parking lot of Creekside Forest Apartments on Ember Drive. They said it appeared that the victim tried to run to get help and collapsed in front of an apartment.”

Police have not yet identified a suspect or motive in the attack, presumably leaving local residents concerned for the safety of their families. The surrounding Ember Drive community was labeled “notorious” for criminal activity in December 2015 by CrossroadsNews.com. The website claims, “Ember Drive, home to a couple of nightspots, lodges, an apartment complex that could be a poster child for county code violations, and dozens of school-age children, is a street notorious for prostitution and drugs. It is a highly transient area with more than its share of criminal activity.”

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. Given the allegations of criminal activity in the surrounding area, as reported by CrossroadsNews.com, The Murray Law Firm questions the level of security provided to those at the apartment complex and whether this shooting may have been prevented.

  • How did the gunman gain entry to the property? What parking lot security measures, such as bright lighting, gated entry, surveillance cameras, and security patrols, were in place and working at the time of the shooting?
  • Was the apartment complex aware of any prior criminal activity on or near the property?  If so, were additional security precautions implemented by the property owner or management to deter crime?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security, the victim may elect to seek justice and pursue a legal claim for his injuries.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.

While many people use local parking lots to finalize online purchases and sales from sites, such as Craigslist, these transactions are all too often a setup to lure an unsuspecting victim into a robbery.

Following a string of “Craigslist-related crimes,” The AJC reports, several Georgia police departments are now offering a safe alternative to parking lot meetings for online consumers.

Georgia Police Departments Offering Safe Online Transaction Services

11 Alive lists several Georgia police departments welcoming people to use their free services when making online transactions:

Cobb County

Smyrna Police have a program called “Operation Safe Sale” where residents can make transactions in the Departments lobby and request a police officer be present.

Kennesaw Police advise residents to use their lobby or parking lot.

Cherokee County

Canton Police said citizens are welcome to use their parking lot which is well lit and has surveillance cameras.

Clayton County

College Park Police said residents are welcome to use their parking lot and they are looking into providing a safe place in their lobby.

Riverdale Police recommend residents use their parking lot.

Morrow Police offer a safe place to meet. Citizens can go inside their building and have an officer present between the hours of 9-am and 5-pm.

Gwinnett County

Gwinnett County Police said citizens are welcome to use their parking lot or lobby and request an officer be present for the sale.

Safety Tips for Smart Online Shopping

According to The AJC, “[o]fficials across the metro Atlanta area have encouraged people to shop smart online, and to follow these tips:

  • Insist on a public meeting place, such as cafe or bank or police station.
  • Do not meet in a secluded place, or invite strangers into your home.
  • Be especially careful when buying/selling high-value items.
  • Tell a friend or family member where you’re going.
  • Take your cellphone along if you have one.
  • Consider having a friend accompany you.
  • Trust your instincts.

Parking Lot Patron Rights

By law, parking lot owners are required to protect all patrons legally on the premises from any foreseeable harm. Should the property owner or management company fail to provide adequate safety and security measures, they may be held civilly liable for any injuries or wrongful deaths which occur as a consequence.

Security Failure? Our Legal Take: Stone Mountain Shopping Center Shooting

Did negligent security contribute to the death of one man and the injury of two others? Read Our Legal Take to find out if the if the victims and their families may have a legal avenue for justice and a claim for compensation.

Local News

A shooting at a Stone Mountain shopping center reportedly claimed the life of one man and left two others injured Friday night, August 5, 2016.

11 Alive News reports, police “responded to 971 North Hairston to a call of two people shot outside of Hairston Village Shopping Center. DeKalb Police Lt. Shane Stanfield said one person was dead at the scene and another man [was] injured and taken to Grady Memorial Hospital.” A third shooting victim was reportedly transported for medical treatment in a private vehicle.

Police are apparently still searching for suspects and a motive. CBS 46 reports, the assailants “fired numerous rounds at the victims, who did not appear to be armed, before fleeing the scene.”

Our Legal Take

Shopping center patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those in the shopping center parking lot and whether this shooting may have been prevented.

  • What security measures, such as bright lighting, surveillance cameras, and security patrols, were in place and working at the time of the shooting?
  • Was the shopping center owner aware of any prior criminal activity on or near the property?  If so, were additional security precautions implemented by the property owner or management to deter crime?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the shopping center owner or management company failed to provide adequate security, the victim’s family may elect to seek justice and pursue a legal claim for his wrongful death. Additionally the other victims of this attack may pursue claims for their injuries.
