Motel Security Failure? Our Legal Take: Atlanta Super 8 Motel Robbery, Assault

Local News

A woman was reportedly robbed and beaten in a “Super 8 Motel room on Jonesboro Road” in Atlanta Wednesday, April 20, 2016.

Fox 54 News reports, “two males knocked on the door of hotel room and forced their way into the room….The suspects pistol-whipped [the victim] in the face and head, and stole approximately $200 and a cell phone.”

The victim was transported to the hospital with injuries. Police are still searching for the suspects.

Our Legal Take

Motel guests have a right to feel safe and secure while on property. The Murray Law Firm questions the level of security provided to residents and guests of the Super 8 motel, and whether this horrific assault may have been prevented.

How did the suspects gain entry to the property? What security measures, such as security fencing, bright lighting, surveillance cameras, and security patrols, were in place to protect guests at the time of the break-in?

  • Recent crime reports reveal a number of local thefts, robberies and burglaries in the area. Were any additional security precautions implemented by the owner and management to deter such crime?

By law, motel owners are required to protect all guests legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the motel owner or management failed to provide adequate security, the victim may elect to seek justice and pursue a legal claim for her injuries.

Based upon its long, extensive, and successful experience in handling negligent security cases in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the motel and property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.

Security Failure? Our Legal Take: Landings at Oak Hill Apartment Shooting

Local News

A 29-year-old woman was reportedly shot and killed inside a Landings at Oak Hill apartment home Friday morning, April 15, 2016.

According to Fox 54, the shooting occurred “around 3:45am at the Landings at Oak Hill apartment complex on the 4300 block of Flat Shoals Road in Union City.”

The 29-year-old victim was apparently struck by “one of several bullets [which] came through her window,” 11 News reports.

Police have not yet identified a suspect or motive in the shooting, presumably leaving residents once again concerned for their safety. Per AJC.com, a fatal shooting reportedly occurred at the same complex in October 2015.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on property. Given the reported history of violence on property, The Murray Law Firm questions the level of security provided to residents of the apartment complex and whether this tragedy may have been prevented.

  • How did the suspect gain entry to the property? What security measures, such as gated-entry, fencing, bright lighting, surveillance cameras, and security patrols, were in place to protect residents at the time of the shooting?
  • Were any additional security precautions implemented by the complex owner and management, following the prior reported shooting, to deter such crime?

By law, apartment owners are required to protect all residents and guests legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security, the victim’s family may elect to seek justice and pursue a legal claim for her wrongful death.

Based upon its long, extensive, and successful experience in handling negligent security cases against apartment complexes in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the apartment and property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.

200389576-001The Canadian Centre for Occupational Health and Safety (COHS) describes the potential risks of workplace parking lots and how employees may protect themselves from parking lot crime.

Always

  • Park near your building in a highly visible and well-lit area.
  • Park near the parking attendant, if there is one, or near the stairs or a well-lit exit in an underground lot.
  • Use the main building entrance–avoid rear or secluded exits.
  • Keep your valuables, including purses and recent purchases, out of sight. Always lock them in the trunk if you have to leave them in the car.
  • Lock the doors and roll up windows once you are in the vehicle.
  • Have a plan ahead of time. Know where you can go for safety and how to call for help.

Do Not

  • Do not use more than one parking spot, as it may anger another person.
  • Do not park next to large vans, trucks or other vehicles, as they will block your sight.
  • Do not have a personal identification tag on your key ring. If your keys are lost or stolen, a thief will be able to find your car or house.
  • Do not approach someone if they are loitering near your vehicle. Walk to a safe place, such as a lighted store, house or building. Call the police.
  • Do not dig in your purse or bag.
  • Do not wear headphones or be distracted by a cell phone conversation.
  • Do not carry heavy briefcases or bags that may get in the way.
