Protestors gathered in July to call for an end to violence and “what they say is the indifference of the property owners at Forest Cove, a troubled apartment complex near the Atlanta federal penitentiary,” according to 11 Alive. In a community with “a long history of violence” it took the unconscionable shooting of a 6-month-old baby to empower and embolden residents all too often silenced in fear.

“Answering a stranger’s questions is a good way to get yourself shot,” a Forest Cove resident told The AJC following a June shooting.

According to WSB-TV 2, the apartment complex “routinely fails inspection by the Department of Housing and Urban Development.” Residents told media “they are frustrated by crime, rodents and broken utilities.”

Georgia apartment residents have a right to protect their families and feel safe and secure in their homes. By law, Georgia apartment owners have a responsibility to protect their residents from violent crime, sexual assault, and foreseeable harm. Unfortunately, all too often, apartment complex owners are more concerned with limiting their financial exposure than protecting tenants and their guests.

The Sandy Springs Police Department urges prospective tenants to check apartment complex crime and security measures prior to renting:

Sandy Springs Apartment Safety Checker

One of the biggest concerns when it comes to renting an apartment is safety.  Feeling safe in your own home is important to any renter.  There are a few steps you can take to help in your research.

  • View the neighborhood crime rate.  Using the Apartment Safety Checker tool, you can compare the criminal activity in your chosen area.
  • Visit the area.  If possible, walk, drive, or take a bus through the area to see how safe it is.  If there is a particular route you would use to get to school or work, use that.  Consider the quality of the area both during the day and at night.
  • During your apartment tour,  look for secure entrances and exits; lighting around sidewalks, stairwells, hallways, mailboxes, laundry rooms and other common areas; and security features such as peepholes, deadbolt locks, and any on-site security.

The Apartment Safety Checker Map, created in conjunction with Sandy Springs Police, provides the numbers on incidents reported within the individual apartment communities.  Included as part of the Apartment Safety Checker program are: Part One Crime (murder, rape robbery, aggravated assault, theft, motor vehicle theft, arson, narcotics offenses), as well as Disorderly Conduct and Loitering/Prowling.  Any unfounded reports of crime  are excluded from the totals.

Could this unconscionable sexual assault have been prevented and is justice available to the survivor?

Security measures are in question after a man was able to break into a woman’s Jonesboro apartment home Friday morning, June 8, 2018, and sexually assault her.

According to The AJC, the assailant “entered through a window in her unit at Tara Bridge Apartments…and sexually assaulted her around 2 a.m.” WSB-TV 2 reports, the courageous survivor “put up a ferocious fight screaming, punching her attacker and trying to run away.” A neighbor finally “heard her screams and called 911, but the accused rapist got away.”

Was negligent security a factor in this Jonesboro apartment sexual assault and could this violent home invasion have been prevented?  Read Our Legal Take below to find out if the survivor may have legal avenues for justice and claims for substantial compensation in Georgia.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided at the subject property and whether this sexual assault may have been prevented.

  • How did the attacker gain entry to the property? What security measures, such as gated entry, fencing, bright lighting, surveillance cameras, and security patrols, were in place to deter crime and protect residents at the time of the sexual assault and home invasion?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the apartment complex owner or management failed to provide adequate security, the survivor of this sexual assault may seek justice and elect to pursue legal claims for her injuries and suffering.

The Murray Law Firm has recovered millions of dollars for victims of unsafe properties in Georgia, and recently obtained a $29.25 million dollar verdict in Georgia.
