Did an equipment malfunction contribute to this work related death and are justice and compensation available to the family of Danny Roth?

OGLETHORPE COUNTY NEWS

A crane collapse at a Oglethorpe County, Georgia rock quarry left one worker dead on Monday morning, May 13, 2019.

According to WYFF4.com, “a crane accident was reported…at [a] Quarry on Allgood Road…the crane fell off the ledge down into the quarry killing one person.”  AccessWDUN.com is reporting, ” the collapse happened around 11:30 a.m., killing the crane’s operator Danny Roth, 58, Carlton.”  Mr. Roth was pronounced dead at the scene according to the report.

The investigation is ongoing.

OUR LEGAL TAKE

Under Georgia Workers’ Compensation laws, our legal team suggests that the family of Danny Roth will most likely be entitled to significant compensation as a result of this accident. While Mr. Roth’s family should be eligible for benefits under Georgia’s workers compensation laws, they may also hold a third-party civil claim against the designer or manufacturer of the crane that collapsed. Because this potential products liability claim is dependent on the facts surrounding the incident, it is imperative that an experienced attorney be retained without delay so as to ensure that all evidence connected to the accident is preserved.

Could this workplace accident have been prevented and are justice and compensation available to the victim?

CONLEY, GEORGIA NEWS

“A worker suffered severe burns in an explosion while he was repairing a semitrailer in DeKalb County on Thursday morning,” AJC.com is reporting.  “The accident happened at the 4300 block of Old McDonough Road, in the southwest corner of DeKalb,” according to WSBTV.com.  “[A] worker was inside the trailer doing welding work when something ignited, causing a large fire, …[and t]he injured worker was taken to Grady Memorial Hospital with severe burns,” per the new outlet.

The fire remains under investigation according to the media reports.

OUR LEGAL TAKE

According to the Georgia workers’ compensation legal team at The Murray Law Firm, as the incident occurred in a workplace setting, the victim will almost certainly be entitled to significant compensation under the Workers’ Compensation laws of Georgia. Additionally, should an equipment malfunction have contributed to this tragedy, the victim may elect to pursue legal claims against the manufacturer.

Based upon its years of experience, The Murray Law Firm warns that employers and insurance companies are concerned with limiting their financial exposure; and, without the guidance of an experienced lawyer, the family’s interests may be jeopardized.
