Was Negligent Security a Factor in the Fatal Shooting of Dominique Devonte Horton?

Local News

A shooting outside a Columbus apartment complex reportedly claimed the life of 22-year-old Dominique Devonte Horton and left another man injured Thursday, January 5, 2017.

According to The Columbus Ledger-Enquirer, gunfire erupted after “a large group of people met on 32nd Avenue to watch two female juveniles fight.” Mr. Horton was apparently struck “near a row of mailboxes at the apartment complex…between Apartment 23 and 24.” Tragically, he succumbed to fatal injuries.

Police apparently “transported lights to the scene to illuminate the parking lot,” according to Ledger-Enquirer reports. “Activity is going on every night,” the “owner of the property” reportedly told The Ledger-Enquirer. The Ledger-Enquirer report suggests that “[p]olice recently seized seven stolen cars that were found on the property.”

Our Legal Take

Apartment complex residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those at the property and whether this tragic loss of life may have been prevented.

  • How did the group gain entry to the property? What security measures, such as gated-entry, fencing, surveillance cameras, bright lighting, and security patrols, were in place and working at the time of the shooting?
  •  Were any additional security precautions implemented by the apartment complex owner or management to deter crime, following prior media reports of criminal activity?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security, Mr. Horton’s family may elect to pursue legal claims for his wrongful death.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.
