Security Failure? Our Legal Take: 2 Killed in Marietta Apartment Shooting

Did negligent security contribute to this fatal shooting? Read Our Legal Take to find out if the victims’ families may have a claim for compensation.

Local News

A shooting outside the Cobblestone Apartment Homes in Marietta reportedly claimed the lives of two young men, ages 23 and 22, Wednesday afternoon, May 25, 2016.

The AJC reports, “Cobb police responded to multiple reports of a shooting at the Cobblestone Apartment Homes on Pat Mell Road,” shortly before 3:00 p.m. Police apparently discovered both victims inside a vehicle suffering from gunshot wounds.

Police have allegedly since charged a suspect with “two counts of murder, two counts of aggravated assault and two counts of armed robbery.”

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those at the apartment complex and whether these shootings may have been prevented.

  • How did the gunman gain entry to the property? What security measures, such as gated-entry, surveillance cameras and security patrols, were in place to protect residents and guests at the time of the shooting?
  • Have there been prior incidents of crime on or near property and, if so, were any additional security precautions implemented by the apartment complex owner or management company to deter crime?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security, the families of the young victims may elect to seek justice and pursue legal claims for their wrongful deaths.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.
