Could This Tragedy Have Been Prevented?

Local News

Gunfire erupted outside of the K & C Short Stop gas station convenience store Tuesday afternoon, May 23, 2017, tragically claiming the life of Rita Henon in front of her young grandchildren.

According to WMAZ 13, Ms. Henon was leaving the “K & C Short Stop at 405 Sparta Highway” with her two grandchildren when an assailant opened fire. The suspect had apparently been “hiding behind the ice compartment” in wait, Sheriff Bill Massee told media.

Police have since charged a suspect in connection with the deadly shooting, per The Union-Recorder reports. Ms. Henon apparently had “no relationship or connection” with the alleged gunman.

Our Legal Take

Gas station patrons have a right to feel safe and secure while on the premises. The Murray Law Firm questions the level of security provided to those at the property and whether this tragedy may have been prevented.

  • Surveillance cameras reportedly show the suspect “hiding” on property prior to the shooting. Were gas station staff or management monitoring these surveillance cameras at the time?
  • Have there been prior incidents of violence on or near property? If so, were any additional security precautions, such as security patrols, implemented by the gas station owner or management?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the gas station owner or management failed to provide adequate security, the family of Rita Henon may seek justice and elect to pursue legal claims for her wrongful death.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.
