Police have made an arrest in the fatal shooting of 44-year-old Calvin Denson, which occurred outside the Warren Williams apartment complex Saturday afternoon, April 30, 2016.

WTVM News reports, Calvin Denson “was found shot and bleeding Saturday afternoon in the parking lot at the Warren Williams apartment complex on Wynnton Road.” Columbus police have since made an arrest in the fatal shooting.

“For the whole entire family, it was a relief for us,” a family member told WTVM News. “Knowing that…the police department along with Sgt. Deaton did everything that they could.”

While the arrest offers some closure to Mr. Denson’s family, grave questions remain over how this tragedy occurred and whether a potential security lapse at the apartment complex may have contributed. Media reports indicate the complex saw another shooting in November 2012.

Our Legal Take

Apartment residents and guests have a right to feel safe and secure while on the premises. Given the reported history of gun-related activity on property, The Murray Law Firm questions the level of security provided to those in the apartment complex parking lot and whether this tragedy may have been prevented.

  • What security measures, such as gated-entry, surveillance cameras, and security patrols, were in place to protect patrons at the time of the shooting?
  • Were any additional security precautions implemented by the property owner, following reports of a previous shooting, to deter such crime?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the apartment complex owner or management company failed to provide adequate security, the family of Mr. Denson may elect to seek justice and pursue a legal claim for his wrongful death.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.
