Negligent Security? Our Legal Take: 1 Killed in College Park Gas Station Shooting

Did negligent security contribute to the death of this College Park man? Read Our Legal Take to find out if the victim’s family may have a legal avenue for justice and a claim for compensation.

Local News

36-year-old William Respress, Jr. was reportedly shot and killed outside a College Park gas station Sunday morning, October 2, 2016.

According to The AJC, the shooting occurred “outside a Shell gas station near the intersection of Whitehall and McDaniel streets near downtown Atlanta.” Gunfire apparently erupted following an argument between Mr. Respress and “a small group of people.” Police are still searching for four suspects, who allegedly “sped away…in a compact silver-gray car.”

Our Legal Take

Gas station patrons have a right to feel safe and secure while on premises of the establishment they are visiting. The Murray Law Firm questions the level of security provided at the gas station and whether this tragic loss of life may have been prevented.

  • What security measures, such as surveillance cameras, bright lighting and security patrols, were in place to protect patrons at the time of the shooting?
  • Was the gas station owner aware of any prior incidents of violence on or near the property?  If so, were additional security precautions implemented by the property owner or management to deter crime?

By law, property owners in Georgia are required to protect all those legally on the premises from any foreseeable harm.  Should the facts of this matter reveal that the gas station owner or management failed to provide adequate security, the family of Mr. Respress may elect to seek justice and pursue a legal claim for his wrongful death.

Based upon its long, extensive, and successful experience in handling negligent security cases against property owners in the State of Georgia, The Murray Law Firm suggests that photographs and a thorough, unbiased inspection of the property will need to be performed immediately, before any evidence may be repaired, damaged or destroyed.
